This agreement is designed to keep you informed as to the limitations of this venue. We, being Roomate Locator, Inc., have the authority to amend this agreement at any time by posting the change to the website. We also have the express right to at any time add, delete, or modify any of our services. By using this site, you are agreeing to be bound by the terms of this agreement. If you do not wish to be bound by this agreement, please do not use or visit RoommateLocator.com nor its family of websites.
ELIGIBILITY OF PARTICIPATION
Use of RoommateLocator.com,
and MilitaryRoommates.com is available only to those who can legally form a
binding contract under law. As such, the use of these sites is not allowed by minors.
We do not accept listings from commercial entities such as other roommate
services or real estate firms. Only those individuals not acting as licensed real estate salespersons or brokers are eligible to list their
rooms for rent or list themselves as roommates. Any company interested in
exposure on our site should contact us for
further information.
DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
a. YOUR USE OF THIS SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON
AN "AS IS" AND "AS AVAILABLE" BASIS. ROOMMATE LOCATOR, INC. EXPRESSLY
DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING,
BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE AND NON-INFRINGEMENT.
b. ROOMMATE LOCATOR, INC. MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET
YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE,
OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE
SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS,
SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU
THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS, AND (V) ANY ERRORS IN THE
SOFTWARE WILL BE CORRECTED.
c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THIS
SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY
RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OR CORRUPTION OF DATA OR HARDWARE THAT
RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM
ROOMMATE LOCATOR, INC. OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY
WARRANTY.
RoommateLocator.com, and MilitaryRoommates.com are venues.
We do not routinely screen or censor any listings on our web sites or in any way
control the postings on the sites.
Roommate Locator, Inc. and its family of web sites RoommateLocator.com and MilitaryRoommates.com do not assume responsibility for
site content and we will not alter or change any listings once they are entered.
Listings will be deleted automatically upon reaching our expiration date for
that listing. Submitted postings which we consider offensive, unlawful,
harassing, libelous or vulgar are subject to being deleted before their
expiration date.
We strongly recommend that you do a credit check as well as check the
references on all potential tenants/roommates.
LIMITATION OF POSTINGS
We do NOT allow the following in the comments section of your postings:
- No posting of contact information is allowed; either addresses, email
addresses, phone numbers, pager numbers, or any other kind of address or contact data.
- We do not allow the posting of another person's name or address in the
comment section. You may only put you your own name.
- We do not allow slanderous or libelous comments.
- In addition, your posting may not be used for any type of illegal activity.
Failure to comply with the above policies may cause your listing to be deleted. We reserve the right
to delete ANY listing which we deem inappropriate for any reason.
Only one posting will be allowed per email address. If
you have circumstances that mandate that you must post multiple listings,
you are required to contact us for authorization to do so. If you post more than one listing per
email address without our prior authorization, we have the right to delete all of your listings.
Roommate Locator, Inc. does not endorse any potential tenant, landlord, management company, or
individual. As far as potential tenants or renters who list with us, we do
not make any representation as to their character, creditworthiness, rental
history or ability to pay their rent. Neither tenants or landlords are under
any obligation to use this service.
Please use care with how you deal with other people on this site. We do not
screen potential tenants nor inspect rental units. We do not guarantee the
identity of the individuals, credit worthiness, character, nor the content
of listings posted to our site. We will not be held
responsible for adverse consequences arising out of contacting or making
associations with users of our web site. All information is submitted
voluntarily and this information will be made available to the public. All
risks for making this information available will be borne by you,
the user.
Our websites provide links to other websites and other
websites link to us. We are not responsible for the privacy policies nor content of these sites.
RoommateLocator, Inc. and its family of web sites are not responsible for
any inaccuracy in their listings. We do not confirm that each user is who they
say that they are and we do not become involved in user to user
relationships. If a dispute should arise between yourself and another
user, you release Roommate Locator, Inc. and its family of web sites as well
as its agents from any claims or damages (actual or consequential) of every
kind, known or unknown, suspected or unsuspected, disclosed and undisclosed
arising from such a dispute. If you are a California resident, you waive
California Civil Code Section 1542 which says "A general release does not
extend to claims which the creditor does not know or suspect to exist in his
favor at the time of executing the release, which, if known by him must have
materially affected his settlement with the debtor."
Our websites may be used for lawful purposes only. Posting of obscene,
defamatory, fraudulent information, offensive content, harassing language
or libelous material is prohibited on our sites. Such actions could result
in the deletion of your posting.
BREACH OF THIS AGREEMENT
You give us a non-exclusive, worldwide, royalty-free, irrevocable,
sublicenseable (through multiple tiers) right to exercise all copyright and
publicity rights, in any existing or future media, known or unknown, over
the material or User Data displayed in Your listings. For the
purpose of this Agreement, "User Data" shall mean all information (if any)
submitted by You, (the "User") to Roommate Locator, Inc. or its
sublicensees. "Individually Identifiable User Data" shall mean that subset
of "User Data" which can be reasonably used to identify a specific
individual such as their name, address, phone number, etc. The User Data
shall be deemed to be the property of Roommate Locator, Inc. You shall take
all reasonable efforts to ensure that it is accurate and complete and not
misleading in any way.
CO-BRANDING
Roommate Locator, Inc. does not sell our information to any other
companies. Any information gathered on our site will only be used for the
purpose it was intended for. That purpose being to secure a roommate.
OUR POLICY ON EQUAL OPPORTUNITY IN HOUSING - All real estate advertised is
subject to the federal Fair Housing Act, which makes it illegal to advertise
"any preference, limitation, or discrimination because of race, color,
religion, sex, handicap, familial status, or national
origin, or intention to make such preference, limitation or discrimination."
We will not knowingly accept or permit any advertisement for real estate
that is in violation of the law. As such, we are not responsible for those who violate the Fair Housing Act using our site. All persons are hereby informed that all
dwellings advertised are available on an equal opportunity basis.
THE LAW
The Civil Rights Act of 1866 prohibits all racial discrimination in the sale
or rental of property. Moreover, the Fair Housing Act declares a national
policy of fair housing throughout the United States, making illegal any
discrimination in the sale, lease or rental of housing, or making housing
otherwise unavailable, because of race, color, religion, sex, handicap,
familial status, or national origin.
As a home seller or landlord you, therefore, have a responsibility and a
requirement under the law not to discriminate in the sale, rental and
financing of property on the basis of race, color, religion, sex, handicap,

national origin. You cannot instruct the licensed broker or salesperson
acting as your agent to convey for you any limitations in the sale or rental
because the real estate professional is bound by law not to discriminate.
Agents in a real estate transaction also are prohibited by law

familial status, or national origin. They are prohibited from complying with
a request from the home
seller or landlord to act in a discriminatory manner in the sale, lease or
rental. Moreover, a home seller or landlord cannot establish discriminatory
terms or conditions in the purchase or rental, deny that housing is
available, or advertise that the property is available only to persons of
a certain race, color, religion, sex, handicap, familial status, or national
origin.
Other laws also impact the purchase, sale or lease of a home or renting an
apartment. Title III of the Americans with Disabilities Act prohibits
discrimination against persons with disabilities in places of public
accommodations and commercial facilities. The Equal Credit Opportunity Act
makes discrimination unlawful with respect to any aspect of a credit
application on the
basis of race, color, religion, national origin, sex, marital status, age or
because all or part of the applicant's income derives from any public
assistance program.
In addition, state and local laws often provide broader coverage and
prohibit discrimination based on additional classes, such as marital status, not covered by federal
law.
As someone seeking to purchase a home or rent an apartment, you have the
right to expect that housing will be available to you without discrimination
or other limitations based on race, color, religion, sex, handicap, familial
status, or national origin. This includes the right to expect equal
